THIS PLATINUM Membership agreement includes services available to landlords who own or manage residential, commercial, industrial, vacational and seasonal properties.

          PURPOSE 
In order for you to be a Member, it is essential that we have an agreement. This agreement can be verbal, or in writing, or via fax, or through any other correspondence. The PLATINUM Member named below wishes to enter into an agreement with LANDLORDS SOURCE CENTRE for the provision of valued products and services. NOW THEREFORE in consideration for being granted access to the business products of LANDLORDS SOURCE CENTRE, and for other good and valuable consideration, by signing below, I, the undersigned, agree with the PLATINUM Membership Agreement as follows:

PURPOSE

Set out the terms and conditions of the contract
Enumerate the services, benefits and privileges provided by LANDLORDS SOURCE CENTRE to the PLATINUM Member, and
Specify the parties rights and obligations of the Member for the duration of the contract
DEFINITIONS

"I", "the Member", "the undersigned", "employees", "agents", "landlord", "property manager", "co-op/real estate interest", and "the party" refer to the Property Owner and/or the Landlord and/or the legal Company name as entered online at www.landlordsinfo.com
"Our", "business", "company", refers to LANDLORD'S SOURCE CENTRE, www.landlordsinfo.com.

             PERIOD OF MEMBERSHIP

Membership fee entitles the landlord to one full year of products and services [a period of twelve consecutive months] beginning the date I agree (verbally and/or in writing and/or through online registration) to become a Member of LANDLORD'S SOURCE CENTRE.


             PROTECTION OF INFORMATION

I hereby agree to secure any and all consents required by applicable law before requesting information from LANDLORD'S SOURCE CENTRE.

I hereby agree that background information pertaining to the tenant(s): credit history reports, court records, eviction search, bank confirmation, employment verification, and tenancy history information, as defined by applicable law, will be requested only when its intended use is as a factor in establishing eligibility for a new lease or extension of lease, rental agreement, collection of rent monies owing, trace or track tenants and employment alert and said information shall only be used for the above-noted purposes.

I hereby agree that personal information will only be requested for and used to determine tenant eligibility and that it will be held in strict confidence even after the termination of this agreement. As a PLATINUM Member, I further agree that all information received from LANDLORD'S SOURCE CENTRE in furtherance of the above requests will be requested only for the Member's exclusive use and will be kept and held by the PLATINUM Member, its agents, assignees, executives and employees in strict confidence.

I hereby agree to protect the privacy and security of the identifying information provided to me as part of my contract to use the website: www.landlordsinfo.com and LANDLORDS SOURCE CENTRE. This information includes but is not limited to: Membership Number, Username, Password, Casework, Tenant Investigations, Update Tenant(s) Credit Report With Credit Bureau, and for all other online and or direct assistance Services, Products, Information accessible as a result of and privilege of my PLATINUM Membership.

             DISCLOSURE OF INFORMATION

As part of my Membership, I recognize the need of the business to access and collect tenant information

I agree to furnish, from time to time, or as requested, at anytime during the course of my Membership, information concerning potential tenants, current tenants and/or former tenants to LANDLORD'S SOURCE CENTRE

             CONFIDENTIALITY

Notwithstanding the termination of this Agreement, the parties herein agree that the obligations of the Member set forth herein and specifically pertaining to keeping information received from LANDLORD'S SOURCE CENTRE confidential shall remain in force indefinitely and LANDLORD'S SOURCE CENTRE.

The PLATINUM Member will receive a private and exclusive membership ID, username and password ("confidential information"); it is the Members responsibility to keep this information confidential at all times during the course of their membership. Any charges, costs or untoward consequences resulting from the disclosure of the Members confidential information will be my sole responsibility.


             INDEMNIFICATION FROM HARM

I agree to indemnify and hold LANDLORD'S SOURCE CENTRE, all its employees, associates, assignees, agents and independent contractors harmless from any expense or damage arising from or resulting any disclosure of information, contrary to the above-noted conditions by the Landlord, Landlord's Spouse, Landlord's family, friends, employees, associates, assignees or agents.

             MEMBERSHIP FEES

All services and products will be charged to the Member at the regular rates established by LANDLORD'S SOURCE CENTRE in the city or town in which the services and or products are rendered and I agree pay for all services rendered on such Member's behalf at those rates.

PLATINUM Membership Fee starts at $448.00 plus applicable taxes. Membership Levels are based upon the number of rental units. To determine your applicable fee, please refer to the PLATINUM Membership Levels and Rate in Table 1.

Membership fee is effective for one full year from the date landlord agrees to become a Member either: online or via phone or via fax or via email or any other method. Membership fee not refundable. PLATINUM Table 1 shows applicable Membership fee. Listed rates do not include applicable taxes.

             LEVELS OF MEMBERSHIP

There are seven (7) levels of PLATINUM Membership as indicated in Table 1 herein.

Each Level includes limited numbers of Products, Services, Benefits and Privileges depending upon the number of units owned or managed.

PLATINUM Membership Fees depend upon the number of rental units owned or managed by the landlord as stated in Table 1 herein.
 
             EFFECTIVE DATE OF MEMBERSHIP

This agreement shall be binding on the earliest of the following dates:

(1) when the PLATINUM Member gives LANDLORD'S SOURCE CENTRE specific written or verbal instructions as to how to proceed; or
(2) when a signed fax confirmation is received by LANDLORD'S SOURCE CENTRE; or
(3) when the confirmation sheet is emailed by Gold Subscriber to LANDLORD'S SOURCE CENTRE.; or
(4) when Membership fee is paid to LANDLORD'S SOURCE CENTRE.

[2]Pro-rated refunds based on monthly period; refund requests for costs incurred for less than a month will be subject to a minimum one-month fee.


             MEMBERSHIP RENEWAL

Membership renewal notifications will be sent to PLATINUM Member via the email address submitted at the time of initial Membership Registration and as stated on file at least 90 days prior to renewal date.

My Membership will automatically be renewed each year with LANDLORD'S SOURCE CENTRE unless I fax, or e-mail or send a registered letter instructing LANDLORD'S SOURCE CENTRE not to renew my annual Membership. Said written instructions must be received within 10 calendar days of the renewal date.

             TERMINATION AND FULL REFUND OF MEMBERSHIP RENEWAL

Membership renewal fee is refundable. Cancel at anytime pro-rated refund - no questions asked! Listed rates do not include applicable taxes.

             SEVERABILITY OF MEMBERSHIP

Written notice by either party will terminate this Agreement on or before the date specified in the notice.

Outstanding accounts owing will immediately become due after membership is severed.

Additional payment at posted non-member rates will be applicable for any and all services charged at PLATINUM Membership rates if PLATINUM Membership is severed prior to expiration date.

             SURVIVABILITY

The obligations and agreements of the Member set forth in preceding Clause 6 [six] PROTECTION OF INFORMATION and Clause 9 [nine] DISCLOSURE OF INFORMATION will remain in force at all times during the effective PLATINUM Membership and even after membership is severed.

             AMENDMENTS

No changes to this agreement may be made except by consent in writing of the President and C.E.O. of LANDLORD'S SOURCE CENTRE.

             SERVICE AND PRODUCT REQUESTS

Service requests and products may be ordered from LANDLORD'S SOURCE CENTRE online at www.landlordsinfo.com, or by calling or by faxing requests or sending requests via email to LANDLORD'S SOURCE CENTRE at landlords@landlordsinfo.com. All information and products provided by LANDLORD'S SOURCE CENTRE are subject to information provided by the PLATINUM Member. The PLATINUM Member agrees to pay for all products and services requested whether the request is in writing, online, verbal, via fax or via email.

PLATINUM Member and/or PLATINUM Members representatives named herein agree to clearly indicate their name, company name (if relevant), telephone number, fax

         SCHEDULE A -  DELINQUENT TENANT DATABASE UPDATING TENANT CREDIT REPORT

CLEAR REQUEST OF TENANTS TO BE CHECKED
When requesting a Tenant Investigation, which includes the Credit Report, the Member agrees to specifically instruct LANDLORD'S SOURCE CENTRE (indicating clearly) which tenant or tenants is/are to be checked, particularly, if a tenant application has two or more tenants on it. In the event that the Member fails to clearly instruct LANDLORD'S SOURCE CENTRE, the Member hereby agrees to the checks made of all tenants listed on the tenant application form and to pay in full for all charges incurred.

LANDLORDS RESPONSIBILITIES
Member agrees to provide clear instructions as to which tenant(s) is/are to be checked, particularly if a tenant's application has two or more tenants listed on it. In the event that the Member fails to clearly specify the tenant(s) to be checked, the Member will still be responsible for the costs, if any, incurred as a result of the "wrong" search performed. Information provided form LANDLORDS SOURCE CENTRE on the wrong tenant(s) will be considered a valid search nonetheless and the Member will be deemed to have EITHER used one of his/her FREE tenant investigations or be charged the applicable fee(s).

3. RESPONSIBILITY FOR CORRECT INFORMATION
It is the responsibility of the Member and/or Member's representative(s) to ensure that their contact information and the names of the tenant(s) to be checked out are stated clearly when requesting a tenant investigation or credit check. Results will be given to landlord by fax, or email, or over the telephone.

PROOF OF TENANCY
In addition, the PLATINUM Member agrees to provide acceptable proof of tenancy and acceptable proof of delinquency to LANDLORD'S SOURCE CENTRE within 7 days of making a request regardless of how request was made.

Acceptable proof of tenancy is at least one of the following:

Lease
Rental Agreement;
Two-sided copies of cancelled cheques from at lease three (3) consecutive Months.
The front of the cheque must state in the memo section "Rent";
Three (3) consecutive rent receipts clearly stating the relevant tenant's name and rent amount;
Court Order or Board Order

PROOF OF DELINQUENCY
Acceptable proof of delinquency is at least one of the following:

Court Order or Board Order;
Landlord's Affidavit clearly outlining the reason why said tenant should be listed on the Delinquent Tenant Database and, if relevant, why the tenant's Credit Report must be updated with the Credit Bureau
NSF cheques copied on the front & back;
Rent statement for a period of not less than 6 months clearly showing rent paid, date paid and if relevant rent owing;
Letters from other tenants (this must be accompanied by an Affidavit from the Landlord clearly outlining the reason why said tenant should be listed on the Delinquent Tenant Database and if relevant why said tenant's Credit Report must be updated with the Credit Bureau).

LISTING BAD TENANTS
The Member agrees to specifically instruct LANDLORD'S SOURCE CENTRE (indicate clear instructions about) which tenant or tenants are to be listed on the Delinquent Database or which tenant's credit report are to be updated with the Credit Bureau, particularly, if a tenant application has two or more tenant on it. In the event that the Member fails to clearly instruct LANDLORD'S SOURCE CENTRE, the Member hereby agrees to state that all tenants named therein should be listed and updated.

         SCHEDULE B -  PLATINUM MEMBER TENANT INVESTIGATION PROCEDURE

DELINQUENT TENANT DATABASE UPDATE
The Delinquent Tenant Database helps and services landlords throughout North America (Canada & US wide), Europe and the United Kingdom.
    DEFINITIONS
       In this Schedule "A" 
         "Bad Tenant", refers to tenants who owe landlords money as a
            result of rent arrears, damages or other matters relating to the rental or lease of property.

This service is available only to PLATINUM MembersThe PLATINUM Member agrees to notify LANDLORD'S SOURCE CENTRE in writing, via facsimile (1-800-627-7725), E-mail, regular mail, by courier or online at landlords@landlordsinfo.com of any and all delinquent tenants.

The request must clearly state the landlord's name, address, telephone and a clear statement asking LANDLORD'S SOURCE CENTRE to list said tenant on the Delinquent Tenant Database and to update tenant's credit report with the Credit Bureau subject to PLATINUM Member providing proof of tenancy and proof of delinquency within 7 days of making a request regardless of how request was made.

There is no charge to the PLATINUM Member to access this database through LANDLORD'S SOURCE CENTRE.

CREDIT REPORT UPDATE
In addition to listing bad tenants reported by PLATINUM Member on the Delinquent Tenant Database, LANDLORD'S SOURCE CENTRE will also update said tenant's credit report with the Credit Bureau.

This is a FREE service to PLATINUM Members Only. It is understood and agreed however that the final decision whether or not to list a tenant on the Delinquent Tenant Database and/or to update a tenant's credit report with the Credit Bureau lies with LANDLORD'S SOURCE CENTRE.

REPORTING OF RESULTS
Results will be reported by one method only, either: email, or fax, or over the telephone, or via regular mail. The Member agrees to pay $5 per tenant for each additional method of reporting of tenant investigation report and/or Credit Check report and an additional $1 per missing address item: Street Name; Street Number; City or Town; State or Province; Zip Code or Postal Code.

WHEN THE SAME TENANT IS CHECKED MORE THAN ONCE
The Member agrees to pay the full applicable rate for each tenant investigation, even if the same tenant was checked more than once as per the Members instruction

DEADLINES FOR REQUESTS
Mondays to Fridays 7:00 am to 3:00 pm will receive the results usually within 60 minutes - Guaranteed to be completed within 24 hours. Tenant Investigations Requests received after 3:00 pm on Fridays, Saturdays, Sundays and Public Holidays are guaranteed to be completed within 72 hours. * Delays Due To Technical Difficulties Exempted

Requests that are delayed as a result of technical difficulties at our website are exempt from guaranteed completion times.

PAYMENT
Member agrees to pay for Tenant Investigation subject to the Membership Agreement. If Tenant Investigation Report and/or Credit Report results are not received by Member as guaranteed herein, the Member will receive that FREE OF COST.
